Distance Sales Agreement
Buyer details, scope, features, price, payment information and accepted document version shown at checkout form the order-specific part of this agreement.
1. Parties, subject and purchase purpose
This agreement covers remote digital services between WebKurucu and the buyer. The buyer declares business/professional or personal purpose at checkout, subject to the true nature of the transaction and mandatory law.
2. Scope and changes
Scope is determined by the recorded package features and any written quotation/brief. Additional pages, features, integrations, content or major redesign may require extra price and time.
3. Price, tax and payment
Price, recurring fees, taxes and third-party budgets are shown before payment. Card data is not directly stored by WebKurucu. Unless otherwise agreed, final source/admin access is handed over after full payment.
4. Start of service
Service starts after order/payment requirements, receipt of necessary content/access and scheduling. A consumer’s separate explicit request is recorded when work is to start before the 14-day period ends.
5. Stages, revisions and approvals
Brief, design, development, launch and delivery stages apply as relevant. Recorded approvals evidence acceptance of a stage. Revision limits are stated in the package/quotation, and customer delays extend the schedule.
6. Digital delivery
A website is delivered by publication, preview, admin access or file handover; reports by electronic delivery/panel; recurring services by performance during the period. Date and method are recorded.
7. Withdrawal, cancellation and refunds
Turkish consumer law applies to consumer transactions. Statutory exceptions may arise for early-started services with explicit consent and immediately performed/delivered electronic services or intangible goods. Exceptions do not remove mandatory defective-service remedies.
8. Intellectual property and customer content
The customer confirms rights to supplied content. Licence/assignment scope, third-party licences and source handover are order-specific. Preview before full payment is for review and does not itself constitute transfer unless agreed.
For packages shown as a WebKurucu licensed site, the customer receives a right to use the site for the stated business and domain. Source ownership, copying, resale or transfer rights are not assigned unless separately agreed in writing. The Licence and Use Terms form part of this agreement.
If the agreement ends with a lawful or mutually agreed full refund after delivery, the project licence ends unless otherwise agreed. The buyer must stop publication/use and delete controlled delivery copies; pre-existing buyer-owned content is excluded.
9. Defective service and support
The customer reports non-conformity with details. WebKurucu reviews and corrects where appropriate. Statutory remedies remain reserved; maintenance/new features are separate from defect correction.
10. Disputes
Turkish law applies. Consumers and business parties may apply to legally competent authorities. Parties should first seek resolution through recorded communication.
